Professional concrete services agreement for Little Apple Concrete customers in Manhattan, Kansas and surrounding areas.

Effective Date: January 1, 2024

These Terms of Service ("Terms") govern your use of services provided by Little Apple Concrete, a concrete contractor business located in Manhattan, Kansas. By engaging our services, you agree to be bound by these terms.

1. Services Provided

Little Apple Concrete provides professional concrete services including but not limited to:

  • Concrete driveway installation and repair
  • Concrete patio construction
  • Stamped and decorative concrete
  • Concrete staining and polishing
  • Concrete repair and restoration
  • Commercial concrete services
  • Emergency concrete repair

All services are provided in accordance with industry standards and local building codes in Kansas.

2. Service Area

Our primary service area includes Manhattan, Kansas and surrounding communities within a 30-mile radius, including but not limited to:

  • Manhattan, KS (Riley County)
  • Junction City, KS (Geary County)
  • Wamego, KS (Pottawatomie County)
  • St. Marys, KS (Pottawatomie County)
  • Surrounding rural areas as agreed upon

Service to locations outside our standard area may be available upon request and mutual agreement.

3. Estimates and Pricing

Free Estimates: We provide free, no-obligation estimates for all concrete projects. Estimates are valid for 30 days from the date provided unless otherwise specified.

Pricing: Final pricing is based on written estimates and agreed-upon project specifications. Any changes to project scope may result in pricing adjustments, which will be discussed and approved before implementation.

Payment Terms: Payment terms will be specified in individual project agreements. We accept cash, check, and major credit cards unless otherwise arranged.

4. Project Scheduling and Performance

Scheduling: Project start dates are estimated based on weather conditions, material availability, and crew scheduling. We will make every reasonable effort to meet agreed-upon timelines.

Weather Delays: Concrete work is weather-dependent. Projects may be delayed due to rain, extreme temperatures, or other weather conditions that could affect concrete quality and safety.

Site Access: Customer is responsible for ensuring clear access to the work area and adequate space for equipment and material delivery.

5. Materials and Workmanship

Quality Materials: We use high-quality concrete and materials appropriate for Kansas climate conditions and project specifications.

Industry Standards: All work is performed according to industry best practices and applicable building codes.

Permits: Customer is responsible for obtaining necessary permits unless otherwise agreed in writing. We will assist with permit applications when requested.

6. Warranties

Workmanship Warranty: We warrant our workmanship against defects for a period specified in your project agreement, typically one year from project completion.

Material Warranty: Material warranties are provided by manufacturers and will be passed through to the customer as applicable.

Warranty Exclusions: Warranties do not cover damage due to:

  • Normal wear and tear
  • Acts of nature or extreme weather events
  • Damage caused by customer or third parties
  • Failure to follow recommended maintenance
  • Changes in soil conditions or drainage not present at installation

7. Customer Responsibilities

Customer agrees to:

  • Provide accurate information about project requirements and site conditions
  • Ensure safe and clear access to work areas
  • Protect concrete during curing period as instructed
  • Make payments according to agreed terms
  • Notify Little Apple Concrete promptly of any concerns or issues
  • Comply with any local permits or restrictions

8. Insurance and Liability

Our Insurance: Little Apple Concrete maintains general liability and workers' compensation insurance as required by Kansas law.

Property Damage: We will repair or replace any property damaged due to our negligence during the course of normal operations.

Limitation of Liability: Our liability is limited to the cost of repair or replacement of defective work. We are not liable for consequential or incidental damages.

9. Changes and Modifications

Any changes to project scope, specifications, or timeline must be agreed upon in writing by both parties. Additional charges for scope changes will be discussed and approved before work proceeds.

10. Cancellation Policy

Customer Cancellation: Projects may be cancelled with written notice. Cancellation fees may apply if materials have been ordered or work has begun.

Our Cancellation: We reserve the right to cancel projects due to unsafe working conditions, failure to obtain necessary permits, or non-payment of agreed fees.

11. Dispute Resolution

Any disputes arising from these terms or our services will be resolved through:

  1. Direct communication and good faith negotiation
  2. Mediation if necessary
  3. Binding arbitration in Riley County, Kansas if mediation fails

Kansas state law governs these terms and any disputes arising from our services.

12. Privacy and Data Protection

We respect your privacy and protect personal information collected during our business relationship. Information is used solely for project completion, communication, and business purposes. We do not sell or share customer information with third parties except as required for project completion or by law.

13. Environmental Considerations

Little Apple Concrete is committed to environmentally responsible practices including:

  • Proper disposal of concrete waste and materials
  • Use of eco-friendly products when available and appropriate
  • Compliance with all environmental regulations
  • Minimizing environmental impact of our operations

14. Safety Requirements

Safety is our top priority. We maintain OSHA-compliant safety standards and require:

  • Clear work areas free from obstacles and hazards
  • Restricted access to work areas during construction
  • Customer compliance with safety instructions
  • Immediate notification of any safety concerns

17. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
